186Fiber and 186Networks Terms of Service
This document ("Terms of Service" or "ToS") sets forth the terms for services provided by COLI, Inc. dba 186Fiber and 186Networks (collectively, "Provider," "we," "us," or "our"), located at 7280 Rapid City Rd | P.O. Box 100, Rapid City, MI 49676. By signing this ToS, using the Services, or paying for the Services, you ("Subscriber," "you," or "your") agree to be bound by these terms. This ToS applies to all residential and commercial internet access services, including fiber-optic broadband ("Fiber Services") under 186Fiber and additional services such as wireless internet, VoIP, or other network services ("Other Services") under 186Networks. Your use of the Services is also subject to our Acceptable Use Policy ("AUP"), which is incorporated herein by reference and available as a separate document.
This ToS is consistent across the 186fiber.net and 186networks.net websites. For 186Networks subscribers, additional sections for Other Services are included below. Separate addendums or documents may apply to specific Other Services as noted.
If you do not agree to these terms, do not use the Services and contact us immediately to cancel. The Subscriber certifies that he or she is at least 18 years of age or that a parent or guardian has given their express consent. The parent or guardian acknowledges responsibility for the minor's actions.
1. Definitions
- Provider: COLI, Inc. dba 186networks located at 7280 Rapid City Rd | P.O. Box 100, Rapid City, MI 49676.
- Subscriber: Refers to an individual, corporation, or legal entity who incurs usage charges for Provider services, for its own use or who incurs such charges on behalf of a third-party user.
- Services: Internet access, including Fiber Services and Other Services, equipment rental or purchase, installation, and any related features.
- Equipment: Routers, ONU, wireless radios, modems, or other hardware provided or required for the Services.
- Premises: The physical location where Services are installed and used.
- Account: Your billing and service profile, including the registered email address.
2. Services Provided
We will provide the Services as described in your service order or plan selection, subject to availability. Services may include:
- High-speed internet access via fiber or other technologies.
- Data transmission with specified upload/download speeds (actual speeds may vary due to factors like network congestion, device limitations, or distance).
- Optional add-ons like static IP addresses, enhanced security, or VoIP.
Installation may require access to your Premises. You are responsible for providing necessary power, space, and permissions. All materials not billed specifically with sales tax remain the property of the Provider.
Broadband Availability: Provider does not have data caps on any of their current plans but reserves the right to establish and enforce usage limits, limiting the speed of uploads and downloads of any kind and in all protocols, including without limitation, file downloads (FTPs), Web browsing, etc., from time to time, for all residential accounts. Provider also reserves the right to enforce the total bandwidth caps normally posted on its corporate website under Acceptable Use Policy.
Seasonal Status: Available to subscribers for up to six months out of the year. At least six months of active service is required per year. The monthly charge for internet service is reduced during the inactive months. Subscribers should check current rates for details.
3. Subscriber Obligations
- Provide accurate information for your Account, including a valid email address and contact number for notifications.
- Pay all fees on time.
- Use Services only for lawful purposes and in compliance with this ToS and the AUP.
- Maintain and secure your Equipment and network (e.g., use antivirus software).
- Allow us reasonable access to Premises for installation, maintenance, or removal of Equipment.
- Notify us of any service issues promptly.
- Subscriber shall ensure that its users shall comply with the terms and conditions of this ToS and the AUP.
4. Billing and Payment
- Fees: You agree to pay all charges, including monthly fees, installation, Equipment rental, taxes, and surcharges. Prices are as quoted in your service plan.
- Billing Cycle: Invoiced approximately 20 days in advance. Payment due upon receipt. Billing cycle is your signup date.
- Late Fees: $3 late fee on overdue amounts.
- Payment Methods: Auto-pay encouraged; failure to pay may result in suspension.
- Disputes: Notify us in writing within 60 days of any billing error.
Payment will be billed in advance, payment of all charges are due on the first day of the service period which begins on the date of Subscriber installation or the first of the month depending on services offered. Accounts more than 5 days overdue will be temporarily disabled until full payment is received. A $30.00 reconnect fee will be assessed on all disabled accounts. Accounts more than Thirty (30) days overdue will be canceled and all Provider owned equipment recovered at the subscriber's expense. Accounts terminated due to non-payment are still subject to fees as liquidated damages. Returned checks will be charged a fee of $25.00.
5. Service Rate Increases
All charges are subject to change at Provider's discretion without notice, as long as the new rate is not more than 15% higher than the old rate. If it is, then you will be notified at least 30 days prior to the new rate taking effect. This notification will be sent via email to the email address on your account.
Continued use of the Services after the effective date constitutes acceptance of the new rates. If you do not agree, you may terminate without additional fees, provided you notify us in writing.
6. Changes to Terms or Services
Provider reserves the right to amend this ToS from time to time, in its sole discretion, and any such amendments shall become effective upon promulgation, subject to the terms of this ToS. We may discontinue Services with notice if we cease offering them generally.
7. Term and Termination
- Term: Month-to-month unless otherwise specified.
- Termination: This ToS commences upon activation of service by Provider. Provider shall have the right to suspend or terminate this ToS at any time without prior notice to Subscriber. The Subscriber also agrees that Provider has the right to delete all data, files or other information that resides or is stored on Provider's hardware, if the Subscriber's account with Provider is terminated, for any reason, by either Provider or the Subscriber.
- Post-Termination: It is the subscriber's responsibility to return all Provider owned equipment upon termination of service. If subscriber is unable to do so in a timely manner, Provider will collect the ONU or other outside infrastructure from the location and charge subscriber a service call fee. Provider may leave the mounting hardware at Provider's discretion. Inside equipment such as the customer rented router and POE (Power over Ethernet) device needs to be returned to Provider within 15 days of cancellation. If Provider is unable to retrieve the hardware, subscriber will be charged for the replacement cost of the unreturned hardware. Unreturned property of the Provider may include fees and charges for replacement value of the equipment. Any prepaid balance will not be refunded. Upon breach of this ToS, all of subscribers' rights and privileges shall be immediately terminated and all Subscriber fees shall be forfeited as liquidated damages to Provider.
8. Equipment
- Provided Equipment remains our property; you are responsible for damage or loss.
- You may use compatible customer-owned Equipment, but we do not support it (such as your own router).
- Upon termination, return Equipment or pay fees.
- Router Rental: Router rental includes technical support. Router Rental is payable until the router is returned regardless of whether Internet service is active or inactive. Routers that fail will be replaced free of charge if subscriber brings old router into our office for exchange. A service call fee will be charged if we come to subscriber's residence/business.
9. Installation
Installation costs vary depending on the length of fiber cable required and equipment used to bury. Any additional labor is billed at our current hourly labor rate. Any additional supplies required for your installation will be reviewed with you by the installer prior to installation and is due upon installation. For specific installation fees and details, refer to your job and installation service order document.
Subscriber and User shall indemnify and hold harmless, Provider, its agents and employees from and against any loss, cost, claim, liability, damage, or expense relating to or arising from installation of software or hardware, including antennas and cabling, without limitation, whether arising from negligence or not.
10. Service Calls
Subscriber is responsible for the entire cost of service calls including labor, materials and equipment for all failures which are not the fault of Provider including without limitation, acts of God, weather phenomena, failure of Subscriber's equipment, etc., including service calls to reinstall software.
Service calls for internet related to the connection is $75/hour. Non connection related service calls such as computer issues, other networking issues or installation is billed at $100/man/hour. Service calls for repeated issue for internet connection related have a 6 month warranty.
11. Limitation of Liability
To the maximum extent permitted by law:
- Services are provided "as is" without warranties.
- All materials, information, software, products, equipment, and services included in or available through Provider (the "Content") are provided "as is" and "as available" for your use. The Content is provided without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Provider and its licensors, agents and employees do not warrant that the Content is accurate, reliable or secure; that the Services will be available at any particular time or location; that any defects or errors will be corrected; or that the Content is free of viruses or other harmful components. Your use of this system is solely at your risk.
- Provider shall not be liable for interruptions caused by failure of equipment or services not provided by Provider, failure of communications, power outages, or other interruption not within the complete control of Provider, nor shall Provider be liable for performance deficiencies caused or created by Subscriber's or its users' equipment. Subscriber and user hereby release Provider from liability arising from any Content accessed via the Service. Provider's performance under this ToS shall be excused in case of labor difficulties, governmental orders, civil commotions, acts of God, or other conditions or circumstances beyond its reasonable control. Provider shall not be liable if changes in operation, procedures, or services require modification or alteration of Subscriber's or its users' equipment, render the same obsolete or otherwise affect its performance. In no event shall Provider be liable for any incidental, special, consequential, or punitive damages including but not limited to loss of profits, loss of business or business opportunity, loss of use, etc. The liability of Provider for actual proven damages for any cause whatsoever, including but not limited to any failure of or disruption of service, regardless of the form of action, whether in contract or in tort or otherwise, including negligence, shall be limited to an amount equivalent to charges payable by Subscriber under this ToS for the service during the period such damages occur. Provider makes no other warranties or representations, either express or implied, concerning the service, and expressly disclaims warranties of fitness for a particular use or purpose, the warranty of merchantability and any other warranty implied by law.
- No liability for third-party content, outages, or force majeure events.
12. Indemnification
Subscriber and User shall indemnify and hold harmless, Provider, its agents and employees from and against any loss, cost, claim, liability, damage, or expense (including reasonable attorneys' fees) to third parties, relating to or arising from the use of the service by Subscriber, User, or any of their personnel, whether or not Subscriber or User has knowledge of or has authorized such access or use, including, without limitation, claims for libel, slander, an invasion of privacy, infringement of copyright, patent infringement (where Subscriber or User has used, connected, or combined the service with the products or services of others), negligence, breach of security, or tortuous behavior. Subscriber agrees to indemnify Provider along with any parties from whom Provider obtains network services, and to hold them harmless from any claims resulting from the use of the service by Subscriber or its users that damage another party or that violate the law.
13. Dispute Resolution
- Disputes: In the event Provider is required to engage the services of an attorney because of a breach by the Subscriber of any of the terms herein contained or arising out of the Subscriber's use of the services in any other manner, the Subscriber agrees to pay all of Provider's reasonable attorney fees and court costs.
- Arbitration: Disputes resolved by binding arbitration under AAA rules (no class actions).
- Governing Law: Laws of Michigan.
- Venue: Courts in Kalkaska, Michigan.
14. Privacy
We collect and use data per our Privacy Policy (available on our websites). Notifications sent to your Account email.
15. Content
Provider shall have the sole right to decide what information (Web Page content, etc.) can or cannot be uploaded onto, or reside upon, Provider's system and Provider has the right to delete all such information data, or files that it decides cannot reside on Provider's hardware.
16. Additional Provisions for 186Networks Services
For subscribers on 186networks.net, this section applies to Other Services (e.g., wireless internet, VoIP, managed networks):
- Wireless Services: Subject to signal availability; no guaranteed speeds outdoors.
- VoIP Services: 911 may not work during outages; you must provide accurate location info. (UPS battery may be required and can be purchased separately for VoIP Services)
- Managed Services: We may access your network for maintenance.
- Separate addendums for VoIP or other specialized services will be provided and signed if applicable. These may include additional AUP restrictions (e.g., no auto-dialing for VoIP).
For consistency, core ToS text remains identical to 186Fiber versions.
17. Miscellaneous
- Entire Agreement: This ToS represents the complete understanding between the parties as to the subject matter hereof, and supersedes all prior written or oral negotiations, representations, guaranties, warranties, promises, orders, statements or agreements between the parties or any statement or representation made or furnished by any other person representing or purporting to represent either party.
- Severability: Invalid provisions do not affect others.
- No Waiver: Failure to enforce does not waive rights.
- Assignment: We may assign this ToS; you may not without consent.
- Force Majeure: No liability for events beyond control (e.g., natural disasters).
