186Fiber and 186Networks Acceptable Use Policy
This Acceptable Use Policy ("AUP") governs your use of services provided by COLI, Inc. dba 186Fiber and 186Networks (collectively, "Provider," "we," "us," or "our"), located at 7280 Rapid City Rd | P.O. Box 100, Rapid City, MI 49676. By using the Services, you agree to comply with this AUP. Violations may result in suspension or termination of your Services as described in our Terms of Service ("ToS"), which is incorporated herein by reference and available as a separate document.
This AUP is consistent across the 186fiber.net and 186networks.net websites.
1. General Prohibitions
You agree not to use the Services in any way that violates laws, infringes rights, or harms our network or other users. Prohibited activities include, but are not limited to:
- Illegal activities: Transmitting or storing material that violates federal, state, or local laws (e.g., child exploitation, threats, or fraud).
- Infringement: Violating intellectual property rights, including unauthorized sharing of copyrighted material.
- Harmful content: Distributing viruses, malware, worms, Trojan horses, or other destructive code.
- Interference: Actions that disrupt our network, such as denial-of-service attacks, port scanning, or excessive bandwidth use.
- Spam: Sending unsolicited bulk email, messages, or advertisements.
- Impersonation: Forging headers, spoofing IP addresses, or misrepresenting identity.
- Unauthorized access: Attempting to gain unauthorized access to any computer system, network, or data (e.g., hacking, cracking).
You agree not to use the Services to transmit, distribute, store, or otherwise make available any content -- including text, communications, software, images, sounds, data, or other information -- that:
- Is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortious, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), or otherwise violates Provider's rules or policies;
- Victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
- Infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party;
- Constitutes unauthorized or unsolicited advertising, junk or bulk e-mail (also known as "spamming"), chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling;
- Contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or other information of any third party; or
- Impersonates any person or entity, including any employee or representative of Provider. You further agree that you will not knowingly solicit or collect personal information from a minor without appropriate prior verifiable parental consent.
Provider does not monitor content transmitted through the Services.
Subscriber and/or users shall not establish Internet servers of any kind, including without limitation, Web, E-Mail, games, FTP, or the like, without prior written authorization and pricing agreement from Provider.
Subscriber also agrees to all Provider Policies shown on or linked from its corporate website. The website is currently located at www.186networks.net.
2. Connection Sharing
Connection sharing is not permitted. You may not:
- Resell, redistribute, or share the Services with third parties outside your household or business Premises (e.g., no public Wi-Fi hotspots, resale or sharing with neighbors).
- Use the Services to operate a commercial server, host multiple unrelated users, or provide internet access to non-authorized individuals.
- Connect the Services to public networks or allow unauthorized access.
- "SHARE" the broadband Internet connection with users outside their residence, building or suite.
Residential Services are for personal, non-commercial use within a single household. Business Services may allow limited internal sharing but prohibit resale. Subscribers rights herein granted cannot be transferred, assigned, shared, sold, or used by anyone other than the Subscriber. No more than one connection to the services can be used at any time by the Subscriber on any system account.
3. Network Management
We may monitor network usage to ensure compliance and optimize performance. Excessive use (e.g., beyond fair usage thresholds) may result in throttling, suspension, or termination.
4. Enforcement
Violations may lead to immediate suspension or termination without refund. Sharing of the broadband service will result in termination of service and Subscriber agrees that all monies received by Provider from Subscriber will be forfeited to Provider. We may report illegal activities to authorities.
